A lawsuit has been filed in a Denver Federal Court that names the Environmental Protection Agency (EPA) and its contractors; EPA Administrator Gina McCarthy; and President Barack Obama in a criminal conspiracy to despoil the beauty of Colorado and surrounding western states.

EPA workers breached a wall of loose debris that was holding back a pool of mustard-hued wastewater containing heavy metals and chemicals from the Gold King Mine near Silverton, Colorado. This gold mine was abandoned in 1921. A plume of three million gallons of orange-yellow water gushed into Cement Creek and the Animas River. The plume traveled through Durango and Navajo Nation land in New Mexico, forcing warnings against touching the water, drinking it or using it for irrigation. The state of Utah may also be affected.

The plaintiffs are the Attorney Generals of the states of Colorado, New Mexico and Utah, who have been joined in the lawsuit by lawyers from the Navajo Nation. Besides remuneration for the Animas River toxic spill the plaintiffs want the EPA to keep their hands off the other 23,000 abandoned mines in Colorado.

After many meetings at the White House with President Obama and his cabinet, White House Press Secretary Josh Earnest announced that US Attorney General Loretta E. Lynch will lead the defense team with US Solicitor General Donald B. Verrilli, Jr. assisting. Mr. Earnest would not provide the strategy to be employed by the defense team.

However, an unclassified email was leaked by a White House aide to the New York Times that blames Republican President Calvin Coolidge and the Department of the Interior’s Bureau of Mines for not taking any action in 1921. The email went on to indicate that former government employees and witnesses would be extremely hard to find!
